Mom says she and daughters kicked out of Aiken County restaurant

An Aiken County woman says she and her daughters were kicked out of a restaurant in the small town of Jackson because her 4-year-old child was crying. The little girl is autistic.

Gail Martin and her daughters just wanted to grab at bite to eat at the Buckhead Cafe in Jackson one day last week. The family was just about to order when 4-year-old Alyssa began crying; she suffers from autism and that made one customer very upset.

“He said, you need to pick her up and you need to get her out of here now,” Gail said.

Gail didn't know who was yelling at her at first, but turns out it was Jackson Police Chief Dennis Rushton, who was eating in another part of the restaurant.

“I wasn't embarrassed from Alyssa's behavior. I was embarrassed at the way it was handled,” she said.

Now Alyssa's family wants an explanation. Her grandfather, Ray Martin, says Chief Rushton knew his granddaughter was autistic. But when he spoke to Rushton, instead of getting an apology, he says he got this response.

“I'll tell you the answer he told me 'it was irritating me, getting on my nerves and beginning to make my head hurt,” Martin said.

Martin says he met with Jackson Mayor Todd Etheridge to get an apology.

“They still don't admit any wrong and they said we'll talk to the police chief and he was wrong and that was the extent of it,” said Martin.

We called the mayor's office and we were told he is on vacation. We spoke with Chief Rushton who refused to comment on camera. Martin says his granddaughter is not unruly or a bad child.

“Its autism coming out and you can't tell when an autistic child will have an outburst,” he said.

The family says the restaurant could have handled the situation much better.

“If they had carried her chocolate milk she would have quieted down, she always does,” Martin said.

Gail says even if she never gets that apology, she still wants to bring attention to her ordeal.

“We can't just lock them up they have every right to be out in public like everybody else," she said.

Chief Rushton says he knew the child suffered from autism, but thought that she was extremely loud and disrupting to other customers.

Rushton says he is willing to go through training with the South Carolina Autism Society to help better understand the disorder.

We also spoke with restaurant owner, Connie Dean, but she too had no comment.

Now, the parent realizes this. What kind of situation does a parent think they will find when they go to restaurants? If a parent knows their child will lose their mind around restaurants then it's the parent's fault for bringing their out of control child.

As having personally watched many "Autistic Rages" in my life I can tell you that being able to think clearly enough to have handled a situation any better is almost impossible when you are in a closed area and an autistic child is in the middle of one of their rages. I completely believe him when he says he was getting a headache and I actually commend him for not saying worse.

Making this an 'Autism' thing is ridiculous. Had it been the other child screaming the mother would have no leg to stand on. Every kid screams and cries on occasion. The difference is whether you have an ounce of consideration for others. The mother is looking for someone to blame for her embarrassment at having her lack of courtesy pointed out.

It's not so much what was said to the parent and child, but how it was said. It couldn't have been stated a little more respectful than how the chief said it. The mother also should have eventually taken the chil out for a few minutes until the child had calmed down. Then everybody would have been happy.

Rushton is nothing but a tool. He is also full of himself. He is a complete waste of Jackson's money. Our town basically pays him to ride around for a little bit then go eat a free lunch at either Buckhead or Pizza Stop. Don't believe me, just go see for yourself where he's at around 12-1 o'clock. Don't bother to check the Chinese Restraunt, they won't cater to him there like the other dine ins.

I am appaled at some of the comments left on here. It seems as if you people want to lock up children with Autism & throw away the key! Are the parents suppose to never leave home? The child needs to be exposed to everyday life (i.e. restaurants) how else are they going to be functioning adults when they grow up. Have some compassion & understanding, educate yourself about Autism before you start judging a mother who is trying to do her best for her child!

I believe it is unfair to blame the restaurant owner or the police chief at all. If a child was crying, no matter what problem, the mother should have made the effort to pick it up and try to quiet it then and there in front of others or to carry it outside at least for a bit. Where do people get off that they have a right to leave a child crying, crying, crying with no regard for the public? A disability does not excuse the rude behavior of the caretaker/mother! And lack of milk!

The mother I think have little consideration for others, if my child had a disability and I was in public, the child behavior got a little out of hand, I would take my child out side. Why should you have to put up with me and my child. You paid for your meal, so enjoy it, if I can't control my child in public then I need help. There is a kind way of saying get out, but the cop did what he did because of who he is. Don't fault him for that.

I feel we have a very competent police chief here in Jackson. The accusations against Chief Rushton are total untruths. It is not in his character to be rude or hateful to anyone.I believe you should be able to eat a meal in peace without screaming children with or without autism.

If you know your child needs chocolate milk to calm down, then why not carry it with you? The restaurant is getting a bad rap and they didn't kick them out. They didn't start it. They don't have to carry chocolate milk on their menu. The child should be able to eat in public, yes, but the public should have a reasonable expectation of decent behavior from the children while in public.

I always took my children to child friendly restaurants when they were little. The noise would not bother any mother that had children in the play areas. Just be considerate of the eating establishment and the clientele. Sometimes it is best to eat at home; and NO not everyone wants to listen to a crying child with a disability or without one.

The Buckhead Cafe is a very clean and pleasent place to eat . Staff has always been pleasent, helpful, and very polite. To put Ms Dean on the spot is wrong. No matter what she says people will critize her for her actions or lack thereof. It is encumbant on the childs parents to be respectful of others rights and the rights of a property owner. Just cause the child has austism does not mean that her rights trump all others rights. I feel for the parents and the Chiefs apparent insensitivity

I feel for the parent and child in thi situation, however other people have a right to enjoy their meal in peace. If the child has sensory issues why would the parent subject the child to an environment that may provoke an outburst, surely and outburt is not a comfortable thing to experience on the childs part. To be perfectly honest the sheriff only said outloud what everyone eles was already thinking.

Don't just Say "My daughter has Autism." and expect everyone to back off. certainly more tolerance is warranted, but there are limits. two very good friends of mine both have children with Autism. so, i have some understanding.

As Granny to a 3.5 year old who has autism I am glad that Chief Rushton is willing to go through training on autism, but I would have thought as police chief he would have more compassion for a child and attempted to handle the situation better.
