UPDATE: Murder suspect returns to hospital

AUGUSTA, Ga. - An escaped murder suspect is back in the hospital.

According to the Aiken County Sheriff's Office, Terrance Riley returned to MCG Health on his own free will early Tuesday morning for more medical care.

Riley is a murder suspect in a deadly home invasion that happened last week.

Aiken County investigators say he was accidentally shot three times during the break-in and had to be treated at MCG Health.

Monday investigators say Riley walked out of the hospital over the weekend during a smoke break.

Tuesday morning an Aiken Deputy spotted Riley waiting in the emergency room and notified the Sheriff's Office.

Riley and three others are accused of killing Jerry Tyler of Ridge Spring, South Carolina.

It's hard to beleive that Sheriff Mike Hunt held this warrant and failed to place this alleged murderer under custody. Failure to perform his duties in the manner when he knows where the suspect is and he knows that there is an outstanding arrest warrant is a criminal offense by a law enforcement officer and misconduct in office.

Troy mislead the public by stating on the sheriff website on Friday June 12, 2009, "All four suspects are currently in custody and will be charged with, Murder, Burglary 1st Degree, Possession of a Weapon During the Commission of a Crime and Attempted Armed Robbery." However, Sheriff Mike Hunt was trying to stick MCG with Riley's medical bills and failed to perform his duties and serve the outstanding arrest warrant for murder when he was in their custody. This is a criminal offense of SC laws

The sheriff violated SC SECTION 23-15-50. Arrest of persons against whom process issued; bail. "The sheriff or his deputy shall arrest all persons against whom process for that purpose shall issue from any competent authority commanding such person to be taken into custody or requiring him to give bond, with security."

kno da law ppl..please do..and yu not an officer so yu dnt know whtas going on..n in a yr or so dey all will be locked up for life..so get over it..also..1 mite even b fried..yu know wat dat means..n another ppl who cooments against case can also get jail time..tellin yu wat da head cheif said himself..thanks..rip daddy love yu..
