Adult entertainment store plans to sue Augusta again for the right to re-open

An adult entertainment store's attempt to re-open in Augusta has been stopped once again. In a unanimous vote Tuesday, Augusta commissioners decided to deny X-Mart's request for a business license.

While the meeting was going on, people were praying for that outcome. One hundred people gathered outside the courthouse. They prayed commissioners would not allow X-Mart to re-open.

And their prayers were answered. Commissioners sided with a county attorney who says X-Mart does not have the right to re-open without meeting the county's current adult entertainment ordinance.

Part of that ordinance says stores cannot open in gateway areas. There are 14 gateway areas in Augusta-Richmond County.

The X-mart's property is in one of those areas.

But attorneys for X-mart say a recent 11th District Court decision allows them to open back up without meeting the ordinance and they plan to sue the city again.

"Unfortunately this is going to cost taxpayers a lot of money they didn't need to spend," said William Sussman, attorney.

"There's a lot more to life than just money, said commissioner Jimmy Smith. "We spend it on many things, but this thing is very personal to me," he said.

Attorneys for X-Mart say they intend to file another lawsuit against the city within the next few weeks.
